2. All checks: personal check, bank or cashier checks must clear the bank prior to the removal of horse from the premises--this may take 1 to 2 weeks depending on the type of check received and banking policy.  We do not accept out of country checks, no exceptions. 

3. Monetary Wire Transfers will require a specific time and date to conduct the transaction. An appointment is required of the bank in advance. Out of country purchases must be made through bank to bank money wire transfers and Sunny Springs Farm's bank representative will be the authorized agent to conduct such international monetary transfers.  Monetary bank to bank wire transfer is also accepted for in-or-out of state purchases and Sunny Springs Farm's bank representative will be the authorized agent to conduct such money transfers. Any fees associated with conducting a monetary wire transfer will be added to the total purchase price of the horse. Call for further information.

4. All registration papers, breeder certificates, NRHA competition licenses will either be mailed or given to the buyer once the horse has been paid in full and the transactions have been completed between the registering body, seller and the bank. All checks must clear the bank according to banking policy prior to transferring registration papers.  

  

 

This purchase agreement  is made and entered by and between Nancy B Certain (DBA Sunny Springs Farm  (the “Seller”) and herein after referred to as the SELLER and ____________________________herein after referred to as the BUYER for the purchase of the horse described below:

The buyer understands and agrees to the following total purchase price $__________ USD for _________________________________horse. 

                           

  1. A down payment in the amount of $__________has been received from the buyer for the horse described above.

  2. The balance due is $____________USD and will be paid on or before (date) _____________. Buyer will be invoiced for any additional fees if necessary as agreed upon, to include, board, vet or blacksmith bills or associated banking fees. Horses must be paid in full prior to removal from property. Once said horse has been removed from the property buyer releases all liability and responsibility of Sunny Springs Farm for any known or unknown pre-existent conditions and any or all accidents that may occur that are beyond our control.

  3. A down payment is required to hold the horse for 14 days without boarding charges assessed @$10.00/day. Boarding charges will not be assessed on suckling foals until after they have been weaned.  If no down payment is made, the horse may be sold to the person with monies in hand.  A deposit of $500 (USD) dollars is required to hold the horse. The deposit is used to hold the horse for the prospective buyer until vet examination, shipping arrangements, and payment transactions have been completed or a payment plan has been established.  The deposit will be deducted from the total purchase price of the horse.  

  4. Deposit Refund Policy: If  the buyer should change his decision within 10 days of this signed purchase agreement and not purchase the horse,  Sunny Springs Farm will refund $250 or 50% of the required $500 deposit within 14 days of notification of the buyer's decision not to purchase the horse.  If the prospective buyer provides a larger deposit on the horse all monies will be refunded minus $250 and may be subject to an additional 3% service. The buyer has the responsibility to contact seller via email or phone to inform Sunny Springs Farm (Nancy B Certain) of the change in decision within the 10 day holding period or no refund will be given even if deposit is for suckling foal.  If the deposit transaction was conducted via credit card, the same credit card used to conduct the transaction will be refunded--no exceptions. 

  5. The seller makes no other warranties, expressed or implied to the soundness or health of horse or future health or soundness of the horse, including warranty for a particular purpose or use. The buyer purchases the said horse "As Is"  to include what is noted in the "scars/brands/pre-existent condition" area (#7 above). The Buyer has the option to have a licensed veterinary examine said horse at buyer's expense, before completing the purchase transaction during  the 10 day holding period. Veterinarians require payment in full prior to conducting a pre-purchase exam.

  6. There will be no refund of deposit or purchase price after the horse has been removed from Sunny Springs Farm or  its affiliate farm Sunny Pines Farm.  If the horse is purchased and no veterinary examination has been conducted, Sunny Springs Farm, its owners and affiliates are not liable or responsible for the horse's care, custody or control. The buyer enters into this agreement knowing and accepting the no-refund policy after the 10 day holding period and/or after the purchase transaction is completed and the horse has been removed from the farm.  

  7. Buyer is responsible for all expenses associated with the shipping and transportation of said horse. If horse is to be shipped out of the country, buyer is responsible for all expenses associated with state and federal quarantine laws and use of an outside agricultural or equine agent.  

  8. If a monthly payment plan has been established the horse may be removed from the property under the sole discretion of the seller and only under rare and certain circumstances:   If seller and buyer agree the horse may be removed from the property, the buyer assumes all responsibilities, liabilities and expenses for horse to include care and custody on said horse.  If #_____payments are missed, the horse will be confiscated and all payments made to date will be lost.  The horse is the lien on the remaining balance, no matter what the initial price of the horse was, or how much is paid on the horse. The registration papers and any other association membership papers will not be transferred to the buyer until the horse is paid in full. In the event said horse becomes ill, permanently disabled or dies, having been removed from the property and in the care of the buyer, buyer agrees to fulfill payment, to include payments still owed on the horse. The buyer should take-out a full mortality and major health insurance policy on said horse prior to removal from property. 

  9. If the horse is being held on a deposit for 10 days and while on the property would become permanently disabled or dies seller will refund all monies to buyer. 

  10. Seller will provide buyer with a current negative coggins and have a licensed veterinarian perform a health inspection as required by law for transporting horses at sellers expense. 

  11. Seller will provide buyer with current vaccination, shoeing and de-worming schedule.

  12. Seller will provide to buyer  NRHA competition license transfer (if applicable) breed registration transfer and registration papers when horse has been paid in full or final payment has been received, except in the case of foals and weanlings which will be mailed to the buyer no later than December 31st of the year in which the foal was born.  Seller cannot influence the registration organizations when it comes to foal registrations and breeding certificates.
